Terms of Service

1. Acceptance of Terms

By engaging The Ecom Foundry ("Company," "we," "us," or "our") for services, you agree to be bound by these Terms of Service. These terms apply to all clients, users, and others who access our services.

2. Scope of Services

The Ecom Foundry provides professional services including, but not limited to:

• Ecommerce Automation: Store management, fulfillment setups, and marketing.
• Book Writing & Publishing: Ghostwriting, editing, and distribution assistance.
• Web Development: Custom design, UI/UX, and technical maintenance.

3. Client Obligations

To ensure project success, the Client agrees to:

• Provide all necessary access, data, and assets (logos, manuscripts, store credentials) in a timely manner.
• Review and approve milestones within [5] business days of delivery.
• Maintain the confidentiality of any proprietary strategies or "SOPs" shared by the Company.

4. Intellectual Property (IP)

• Book Writing: Upon full and final payment, all rights to the final manuscript and custom cover art transfer to the Client.
• Web Development: Upon final payment, the Client owns the front-end design and custom content. The Company retains rights to any proprietary code snippets or pre-existing frameworks used.
• Ecommerce Automation: The Client retains ownership of their store accounts and brands. The Company retains ownership of its internal automation processes and logic.

5. Limitation of Liability

The Ecom Foundry is a service provider. We do not guarantee specific financial outcomes, sales targets, or "Bestseller" status, as these depend on market variables outside our control. Our total liability is limited to the amount paid for the specific service in dispute.

6. Governing Law

These terms shall be governed by the laws of the state where The Ecom Foundry is registered, without regard to its conflict of law provisions.
